Version 1.0 - Last updated: 2 November 2026

This End User Licence Agreement (“EULA”) governs your use of the compiled HearMeOut-AAC application distributed by Jericho Crosby (Chalwk) (“the Developer”) through Google Play and, for invited individuals, through the official GitHub Releases page of the Developer’s private repository (the “App”).

By installing or using the App, you agree to this EULA. If you do not agree, do not install or use the App.

This EULA is between you and the Developer. Google and GitHub are not parties to it and have no obligations to you under it.

1. Licence granted

Subject to your compliance with this EULA, the Developer grants you a personal, non-exclusive, non-transferable, non-sublicensable licence to install and run the App on devices that you own or control, to communicate and for other non-commercial purposes. The App is free, and the Developer does not charge for this licence.

For the avoidance of doubt, this licence includes the right to:

(a) use the App to communicate, including by allowing a family member, carer, therapist, support worker, teacher, or other person operating the device at your direction to interact with the App on your behalf;

(b) use the App in your everyday life, including at work or school, to communicate; and

(c) install the App on shared devices owned or controlled by you, your household, or an organisation that supports you (such as a school, clinic, or care provider), so that the App can be used by the people that organisation serves, provided the App itself is provided free of charge.

Professionals such as speech-language therapists, teachers, and support workers may use the App as a tool in their work with clients. They may charge for their own services, but may not charge for the App itself or sell it, bundle it, or make access to it a paid feature.

2. Restrictions

You may not, except to the extent that applicable law expressly permits and that cannot be excluded by agreement:

(a) copy, reproduce, distribute, sublicense, rent, lease, lend, or sell the App or any part of it, other than installing it from Google Play or, if you have been invited, from the official GitHub Releases page as in Section 1;

(b) modify, adapt, translate, or create derivative works of the App;

(c) reverse engineer, decompile, or disassemble the App, or attempt to derive its source code from the compiled form;

(d) remove, obscure, or alter any copyright, trademark, or other proprietary notice in or on the App;

(e) sell, charge for, or otherwise commercialise the App or access to it, or include it as part of a paid product or service; or

(f) use the name “HearMeOut-AAC”, the App’s icon, or other brand assets in connection with any modified version, derivative work, or other product or service.

3. Ownership and third-party components

The App, including all intellectual property rights in it, is and remains the property of the Developer. This EULA grants you a limited licence to use the App. It does not transfer ownership of any kind.

The App includes third-party open-source software, which is licensed under its own terms. Notices for that software are available in the App’s About screen. Nothing in this EULA limits your rights under those licences.

4. Privacy

The App collects no personal data. See the Privacy Policy (https://chalwk.github.io/pages/policies/HearMeOut-AAC/PRIVACY/), which forms part of this EULA.

5. Updates and changes

The Developer may release updates, bug fixes, or new versions of the App at any time and at their sole discretion. The Developer is not obliged to provide updates, support, or maintenance.

Updated versions may be governed by an updated EULA. Where an update materially reduces your rights under this EULA, you may decline the update, continue to use the version you have (subject to any changes required by Google Play’s or GitHub’s terms, as applicable), or stop using the App and uninstall it. Continued use of an updated version after you are shown the new EULA constitutes acceptance of it.

6. Termination

This EULA is effective until terminated. You may terminate it at any time by uninstalling the App. The Developer may terminate it only if you materially breach it. On termination you must stop using the App and delete all copies in your possession or control. Sections 2, 3, 7, 8, 9, and 10 survive termination.

7. No warranty

To the maximum extent permitted by law, the App is provided “AS IS” and “AS AVAILABLE”, without warranty of any kind, express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.

The App is a communication aid, not a medical device, and must not be relied upon as a sole means of communication in an emergency. It is not a substitute for professional assessment or advice. The Developer does not warrant that the App will be uninterrupted, error-free, or available at any particular time, or that its text-to-speech output or word suggestions will always be accurate.

8. Limitation of liability

To the maximum extent permitted by law, the Developer is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, communication, or opportunity, arising out of or in connection with your use of or inability to use the App.

Nothing in this EULA excludes or limits liability that cannot be excluded or limited under applicable law, including (where applicable) the New Zealand Consumer Guarantees Act 1993 and the Fair Trading Act 1986, or consumer laws in the country where you live.

9. General

If any provision of this EULA is found unenforceable, it will be applied to the maximum extent permitted and the remaining provisions stay in effect. Failure to enforce a provision is not a waiver of it. This EULA, together with the Privacy Policy, is the entire agreement between you and the Developer about the App.

10. Governing law

This EULA is governed by the laws of New Zealand. Any dispute arising out of or in connection with it is subject to the non-exclusive jurisdiction of the New Zealand courts. This does not take away any mandatory consumer protections you have under the laws of the country where you live.
